Patient rights.

In their relationship with UMIBA, patients enjoy the rights recognized by Law No. 26.529 and related regulations, among them the following.

Recognized rights.

Framework. UMIBA recognizes and guarantees the rights that Law No. 26.529 on Patient Rights in their Relationship with Health Professionals and Institutions, its amendment Law No. 26.742, and Law No. 25.326 confer on every person who receives care at the center.

First. Care and dignified treatment. Patients have the right to receive care without discrimination and to dignified and respectful treatment, extended to their family or companions.

Second. Health information. Patients have the right to receive clear, sufficient information suited to their capacity for understanding about their state of health, the proposed studies and treatments, their risks, benefits and alternatives, and their prognosis, as well as the right not to be informed if they so express.

Third. Informed consent. No study or treatment is performed without the informed consent of the patient or their legal representative, given in accordance with arts. 5 to 11 of Law No. 26.529, except for the exceptions the law provides.

Fourth. Autonomy of will. Patients have the right to accept or refuse certain therapies or procedures, and to revoke their decision, in accordance with Law No. 26.529 and its amendment Law No. 26.742.

Fifth. Advance directives. A capable adult patient may issue advance directives regarding their health, which will be respected under the terms and within the limits of Law No. 26.529 and Law No. 26.742.

Sixth. Second opinion. Patients have the right to request a second professional opinion on their diagnosis or treatment, without this affecting their relationship with the treating team.

Seventh. Confidentiality and medical secrecy. Patients have the right to the confidentiality of all information related to their health and their medical record, protected by professional secrecy (Law No. 17.132 and art. 156 of the Criminal Code) and by Law No. 25.326.

Eighth. Medical record. The medical record belongs to the patient. They have the right to access its content and to obtain an authenticated copy, which will be delivered within forty-eight (48) hours of the request, in accordance with art. 14 of Law No. 26.529, except in case of urgency.

Ninth. Complaints. Patients may submit inquiries or complaints about the respect of these rights to UMIBA, through the contact channels published on the SITE.
